If your building was built since 1993 and you did not get a building consent you may be able to apply for a Certificate of Acceptance.

Certificate of Acceptance


To apply for a Certificate of Acceptance you must provide all relevant particulars of construction just as if you were applying for a building consent, and proof that it has been built to the standard of compliance.
If your building was built before 1993 and you did not get a building permit you need to engage a building consultant to provide Council with a Safety and Sanitary Report. Council will place this report on file for reference in any future LIM.

Notice to Fix

A Notice to Fix is a statutory notice requiring you to remedy any breach of the Building Act 2004. Some examples of when you may be considered to have breached the Building Act 2004 are if you:
Are doing work without a building consent
Doing work not in accordance with a building consent
Contravening any of the building regulations under the Building Act 2004

A Certificate of Acceptance was introduced in the Building Act 2004. The certificate is based on the Building Code at the time of the application, rather than what was in place at the time consent was granted or when the work was actually carried out.
