Public Notice of Withdrawal of Provisions from Proposed Plan Change 20 (LGAAA) to the Operative Franklin District Plan
Clause 8D of Schedule 1 of the Resource Management Act 1991 (RMA)
Pursuant to clause 8D of Schedule 1 of the RMA, Franklin District Council hereby gives public notice of its decision to withdraw the following provisions of proposed Plan Change 20 to the Operative Franklin District Plan.
i. The proposed provision in Part 26.1.3 relating to ‘An Integrated Transport Assessment for MAJOR TRIP GENERATING DEVELOPMENTS’;
ii. The proposed provision in Part 26.5 relating to ‘MAJOR TRIP GENERATING DEVELOPMENT’ and the proposed amendments to Part 26.5.D;
iii. The proposed provision in Part 27.3 relating to ‘MAJOR TRIP GENERATING DEVELOPMENTS’
iv. The proposed additions to Part 27.8.B;
v. The proposed provision in Part 29.4 relating to ‘SIGNIFICANT TRIP GENERATING DEVELOPMENT’;

The reasons for the Franklin District Council's decision to withdraw the above provisions are:
i. The provisions do not adequately address the resource management issues of the district in respect to the management of traffic associated with Manukau Road;
ii. The provisions apply district-wide and therefore do not discriminate between those activities and locations where development should be enabled, and those where development needs to be carefully managed;
iii. Drafting errors have resulted in difficulties in the administration of the provisions;
iv. The resource management issues are more appropriately addressed by the community through the proposed plan changes to the Operative District Plan.

Samuel Miller Reserve, 42 Nelson Street, Pukekohe.
Pursuant to section 16(1) of the Reserves Act 1977, Franklin District Council hereby notifies its intention to classify the land known as Samuel Miller Reserve as Local Purpose (Neighbourhood Park) Reserve, more particularly described in the Schedule hereto. Council considers that the current purpose of Local Purpose (Council Depot) Reserve is no longer appropriate and it is intended that the land be developed into a neighbourhood park.
A plan showing the area of reserve land to be classified is available for inspection at the main Council Administration Office, located at 82 Manukau Road, Pukekohe. Clause 8D of Schedule 1 of the Resource Management Act 1991 (RMA)
Pursuant to clause 8D of Schedule 1 of the RMA, the Franklin District Council hereby gives public notice of its decision to withdraw the provisions of proposed Plan Change 26 (PC26) to the Operative Franklin District Plan.
The reasons for the Franklin District Council's decision to withdraw PC26 are:
1. PC26 was submitted to Franklin District Council as a private plan change request, and the Council adopted the plan change at its Strategy and Policy Committee meeting on 15 April 2010. The statutory timeframe for notifying PC26, being four months from adoption, has now lapsed.
2. A further plan change request for the Belmont Structure Plan Area has been submitted to Franklin District Council which the Council adopted on 26 August 2010. This is proposed Plan Change 29 (Belmont Structure Plan Area) which has to be publicly notified within four months of the date of adopting the plan change request.
3. PC26 has therefore become redundant, and, to avoid an overlap of proposed plan changes in the Belmont Structure Plan Area, it has been withdrawn.

Plan Change 29 (Belmont Structure Plan Area (Pukekohe West)), Variation 5 to Proposed Plan Change 14 and Variation 1 to Proposed Plan Change 24
Clause 5 of Schedule 1, Resource Management Act 1991 (RMA)
Franklin District Council (FDC) has prepared the following proposed plan change and variation:
Proposed Plan Change 29 (PC29 - Belmont Structure Plan Area);
Variation 5 to proposed Plan Change 14; and
Variation 1 to proposed Plan Change 24.
The purpose of the proposed Plan Change and Variations is to give effect to the Belmont Structure Plan. PC29 and Variation 5 propose to rezone the land within the Belmont Structure Plan Area to the west of Pukekohe from ‘Rural’ to ‘Residential 2’ and ‘Recreation’ and amend the location of the Central Rural Management Area boundary. A new Part 54.16 will be inserted into the District Plan with objectives and policies and subdivision design assessment criteria specific to the Belmont Structure Plan Area. PC29 further involves the scheduling of significant trees and a new ‘Site of Special Wildlife Interest’ (Robinson’s Swamp) will be incorporated into Schedule 5A of the District Plan. The latter will have immediate legal effect from the date of this public notice, in accordance with Section 86B(3)(b) of the RMA.
Variation 1 to PC24 introduces minor amendments to District Plan Part 26: Rule 26 – Subdivision Urban relating to the Belmont Structure Plan Area. In addition, minor remedial changes to Part 26: Rule 26 – Subdivision Urban, Part 19 (Objectives, Policies and Methods: Urban) and Part 54.15 (Pokeno Structure Plan Area) of the District Plan are proposed.

Submissions must be on Form 5 as prescribed in the Resource Management (Forms, Fees, and Procedure) Regulations 2003 and must state whether or not you wish to be heard on your submission. Form 5 is available from FDC’s service centres or from www.franklin.govt.nz. Submissions must arrive at FDC by 4pm on Friday 15 October 2010.
The process after close of submissions will be as follows:
• After the closing date for submissions FDC will prepare a summary of submissions and this summary will be publicly notified.
• There will be an opportunity to make a further submission in support of, or opposition to, any submission already made.
• If a person making a submission requests to be heard in support of his or her submission, a hearing will be held.
• FDC will give its decision (including its reasons for accepting and rejecting submissions).
• Any person who has made a submission has the right to appeal the decision to the Environment Court.
