Summary
The Bylaw prohibits the consumption and possession of liquor in specified public places and will operate between the hours of 10pm and 7am every day throughout the year. However, the Bylaw does not apply when drinking in a licensed area including outdoor dining areas or; if transporting unopened containers to or from a home, restaurant, shop or licensed premises.
The Liquor Control Bylaw applies to public places in the Pukekohe, Tuakau and Waiuku central business districts. These areas are defined by map in the Bylaw and the maps attached with this press release.
The Bylaw also covers a number of Reserves in the Franklin District. They are:
‘Public places’ include all roads and footpaths in the defined areas and areas under the control of Council that are open to or used by the public.
Signs will be erected in central business areas and on reserves to indicate that the Bylaw applies to these areas. Signs in the central business areas will include a map detailing the area covered by the Bylaw. Enforcement of the Bylaw will be carried out by the New Zealand Police. Before exercising the power to search a container or vehicle for liquor, the Police will warn individuals that they are breaching the Bylaw and provide them with a reasonable opportunity to surrender their liquor or leave the area. If convicted of breaching the Bylaw, individuals can face a penalty of up to $20,000.
