District Plan Print


The Council's District Plan is a legal document. We are required to prepare a District Plan under the Resource Management Act 1991 and Franklin's District Plan became operative on February 29, 2000. The District Plan helps us as a district to manage our natural and built resources.

The District Plan provides a single set of resource management provisions that apply to all rural and urban areas in the districts territorial boundaries. Some of the provisions may affect you if you are wanting to build, subdivide or change the use of your land.

Plan Changes

Since becoming operative Council has progressed a number of Plan Changes to the Operative District Plan.

New or amended provisions which are introduced to an Operative District Plan are called Plan Changes. Plan Changes can be initiated by the Council, or by private individuals.

In comparison, new or amended provisions which are introduced to a Proposed District Plan, or a Proposed Plan Change, are called Variations. They can only be initiated by the Council.

The Plan Change process involves:

  • Preparation and notification of Proposed Plan Change
  • Submissions and further submission lodged on Proposed Plan Change
  • Hearing of submissions
  • Council decision on submissions
  • Possible appeal of Council decision
  • Proposed Plan Change made Operative

North Pukekohe Hill Structure Plan Area Design Guide

 

This guide was prepared to assist with the implementation of the North Pukekohe Hill structure plan area and associated provisions in the District Plan (see Part 54.8).

 

 

National environmental standards for telecommunications facilities


The national environmental standards for telecommunications facilities came into force on 9 October 2008. The regulations will substitute existing district plan rules that address the same subject material.

In essence, the standards say:

  • An activity (such as a mobile phone transmitter) that emits radio-frequency fields is a permitted activity provided it complies with the existing New Zealand Standard (NZS2772.1:1999 Radio-frequency Fields Part 1: Maximum Exposure Levels 3kHz-300GHz).
  • The installation of telecommunications equipment cabinets along roads or in the road reserve is a permitted activity, subject to specified limitations on their size and location.
  • Noise from telecommunications equipment cabinets located alongside roads or in the road reserve is a permitted activity, subject to specified noise limits.
  • The installation of masts and antennas on existing strctures alongside roads or in the road reserve is a permitted activity, subject to specified limitations to height and size.
  • The national environmental standards are regulations made under the Resource Management Act 1991. Activities that do not qualify as permitted activities under the regulations will continue to be managed by local councils through the existing rules in their district plans under the Resource Management Act 1991.
